Terms & Conditions — Beyond Madeira

1. Company information

These Terms & Conditions (“Terms”) govern the use of the Beyond Madeira website and any booking request made through our website forms, email, phone or WhatsApp.

No walk-in office: Our registered office is not open to the public for walk-in service. Support is provided remotely (email/phone/WhatsApp) and, when needed, by appointment.

2. Definitions

  • Customer / You: any person who visits our website, contacts us, or requests/books a service through us.
  • Partner / Supplier / Operator: the third-party company that delivers the service (e.g., activity operator, car rental company).
  • Service: any activity, tour, transfer, car rental, or other travel-related service displayed on our website or arranged upon request.

3. Our role (intermediary/agent) and scope of responsibility

Unless explicitly stated otherwise, Beyond Madeira acts as an intermediary that promotes, arranges and assists with reservations for services delivered by independent local partners.

The Partner is responsible for the execution of the Service, including operational rules, safety requirements, equipment, schedules, and the content/limits of any insurance connected to the activity or car rental.

Beyond Madeira provides customer support and coordination, but does not operate the vehicle fleet or run the activities directly (unless clearly stated for a specific Service).

4. Service information

We aim to present accurate information (description, inclusions/exclusions, requirements, duration, meeting points, and policies). However, the final conditions applicable to your booking may depend on the Partner’s terms and operational constraints.

If there is a conflict between these Terms and the specific conditions shown on the product page / booking confirmation, the specific conditions communicated before confirmation shall prevail for that Service.

5. Booking process and confirmation

A booking request can be made through our website forms, email, phone, or WhatsApp.

A booking is considered confirmed only when we send you written confirmation (email or WhatsApp) with the essential details (date/time, pick-up/meeting point, participant/driver requirements, price, and applicable cancellation/payment policy).

You are responsible for checking the booking details and informing us promptly if anything is incorrect.

6. Prices, payments and deposits

Prices are shown on the website and/or in the confirmation message and may depend on availability and Partner pricing.

Usually no upfront payment is required. However, some activities/partners require a deposit or full prepayment to secure the reservation. When this applies, it will be clearly communicated before confirmation.

If an advance payment is required, the payment method, deadline, and refund rules will be stated in the confirmation.

7. Cancellation policy

Standard policy: free cancellation up to 24 hours before the scheduled start time.

Exceptions: some Services may require a different deadline (for example, 72 hours / 3 days) and that specific deadline will be stated on the product page and/or in the booking confirmation.

No-shows, late arrivals, or failure to meet requirements (e.g., age, documents, licence) may be treated as a cancellation without refund, depending on the Partner’s conditions communicated before confirmation.

8. Changes, delays and force majeure

Some Services (especially outdoor activities) may be modified, delayed, rescheduled or cancelled due to weather, safety reasons, operational constraints, road closures, or other circumstances beyond the control of Beyond Madeira and/or the Partner.

In such cases, we will assist you in coordinating the best available solution offered by the Partner (e.g., reschedule, voucher, alternative route, or refund where applicable), according to the Partner’s rules and the nature of the Service.

9. Customer obligations

You agree to:

  • Provide accurate information needed for the booking.
  • Arrive on time at the agreed meeting point / pick-up location.
  • Follow safety instructions and comply with the Partner’s rules and staff directions.
  • Ensure you meet all requirements stated for the Service (age, health conditions, equipment, valid driving licence, etc.).

10. Activities: insurance and safety

Activities are generally covered by the Partner’s insurance (e.g., liability and/or personal accident), subject to the Partner’s policy terms, exclusions, and participant compliance with safety rules.

You must disclose relevant information when required (e.g., medical conditions that may affect participation) and comply with all safety requirements communicated before and during the activity.

11. Car rental (rent-a-car) — key terms (partner-dependent)

Beyond Madeira works mainly with local car rental partners. The exact rental conditions depend on the Partner and will be stated in the booking confirmation and/or the rental agreement presented by the Partner.

  • Credit card / deposit / security hold: many offers do not require a credit card, deposit or security hold, but exceptions may apply and will be disclosed before confirmation.
  • Insurance: insurance is included, but coverage/exclusions vary by Partner. Some Partners may exclude items such as wheels/rims, tyres or glass. Some Partners may offer optional extra coverage for broader protection.
  • Prohibited use: damage, fines, incidents or losses linked to unlawful/negligent conduct (including driving under the influence of alcohol or drugs) are not covered by insurance and remain the driver’s responsibility.
  • Under-21 drivers: some Partners may accept drivers under 21 subject to conditions such as a refundable deposit (e.g., €600), when clearly stated before confirmation.
  • Fuel policy: typically full-to-full or return at the same level, as specified by the Partner.

The rental contract is concluded between you and the car rental Partner. You must read and accept the Partner’s rental agreement before collecting the vehicle.

12. Intellectual property and image credits

Website content (texts, branding, photos and other materials) is owned by Beyond Madeira or used with permission/licence. Where content is not our own, we aim to credit the author/owner when applicable.

13. Complaints and customer support

If you have any issue or complaint, contact us at info@beyondmadeira.com or +351 939 566 415. When the complaint concerns service delivery, we will liaise with the Partner to help resolve the matter.

14. Privacy and cookies

Your personal data is processed in accordance with our Privacy Policy. Cookies and similar technologies are described in our Cookie Policy, including how to manage your consent preferences.

15. Governing law and jurisdiction

These Terms are governed by Portuguese law, without prejudice to mandatory consumer protection rules that may apply.
